Production Registrations: Overseas Commission

UK SPV for overseas commissions
- What you get:
  
  The SPV gets:
  • access to Pact's business affairs support for the life of the production
  • access to Pact's suite of contracts and agreements for the life of the production

  The parent company gets:
  • full membership rights as per the category of membership it applies for
- What you pay:
  
  • The SPV will be required to pay the Pact Production Levy:
  
  To access our services the SPV will need to pay the Pact Production Levy, which is based on the production budget and current rates can be found here.
  
  Please note that the above rates became applicable on Friday 1st April 2022. Prior to that Pact charged a TV Levy for UK companies.

  • The parent company will be asked to pay a membership fee (if it does not do so already):
  
  Membership fees will be charged at the relevant membership rate based on the parent company’s turnover as per the Income Statement of the most recent set of accounts filed at Companies House.

- Eligibility criteria:
  
  • a TV production, commissioned by an overseas broadcaster or overseas SVOD platform, set up through an SPV of a UK parent company.
  • the parent company of the SPV must have Pact Membership
- How long does it take to register?
  
  We will usually be in touch about your registration within 48 hours from receipt of the production form. The time taken to complete registration will depend upon a number of factors, however to help expedite the registration process, as well as submitting a Production Form (using the link below), please also contact Annette Atanda (annette@pact.co.uk) with the following details:
  
  For TV Registrations
  • the production budget, excluding COVID-19 costs
  • the name of the commissioning broadcaster/studio
  • letter of financial guarantee – this is a letter from the commissioning broadcaster and is an Equity requirement. Pact can provide a template upon request. Equity will not accept such letters from smaller, lesser known broadcasters/studios. If this is the case, we will discuss alternative routes to registration with you.
  
  For SVOD Registrations
  • The production budget, excluding COVID-19 costs
  • The name of the commissioning SVOD platform
  • a letter of financial guarantee – this is a letter from the commissioning SVOD platform and is an Equity requirement. Most established SVOD platforms are very familiar with these letters. Please inform us if your commissioning SVOD platform will not be providing this letter and we will discuss alternative routes to registration.
  • rights clearances – please contact Helen Hogan (helen@pact.co.uk) in relation to Equity clearances that you require for your production.
  
  Pact cannot issue production specific cast Forms of Engagement until registration is complete.
  
  Parent company membership (if required) usually takes 48 hours from receipt of a completed application form and payment.

As outlined above, a further condition for registered TV productions that are set up through an SPV where the parent company is UK registered, is that the parent company also has to join Pact (if it is not already a Member).

This needs to be done through a separate application. Find out which Pact Membership to apply for via the Join Us page.

We will get in touch with you to invoice for your Levy and Membership fee as soon as we can, and once we have received payment you will be able to access our services.
